1. Overview
These Terms and Conditions (“Terms”) form the agreement between Point16 Limited (“Point16”, “we”, “us”, or “our”) and you, the participant (“you” or “your”), covering your enrolment in the Business Growth School (“Programme”).
Business Growth School (BGS) is a practical, six-day growth programme for established business owners and leaders - typically from small to mid-sized businesses (around $2M+ revenue) - who want clarity, structure, and confidence in their growth direction.
Built by Point16, a business growth consultancy led by owner-operators who’ve built, scaled, and exited companies themselves, the Programme blends live, in-person workshops, hands-on strategy development, and real-time implementation.
Delivered in small, high-touch cohorts, participants work alongside experienced advisors and peers to create a live, actionable growth plan.
By paying the deposit for the Programme, you agree to these Terms.
2. About the Programme
Business Growth School is a six-day, in-person course held in Auckland (or as otherwise advertised), running over approximately two months. Each cohort includes around 8–12 participants. Cohorts are intentionally small to ensure a personal, high-impact experience.
You’ll explore key areas of business growth through structured learning and immediate implementation:
Day 1: Business Growth Fundamentals
Day 2: Growing Customer Demand
Day 3: Product & Finance Growth
Day 4: Operational Efficiencies
Day 5: Leading Self
Day 6: Strategic Leadership & Beyond
Between sessions, you’ll receive advisory support to embed learning, maintain momentum, and ensure results translate directly to your business.
Participants are responsible for travel and accommodation arrangements relating to the in-person sessions. Dates and locations for the in-person sessions for each cohort will be advised at registration.
3. Pricing and Payment Terms
Pricing for each cohort will be as advertised on our website or otherwise agreed in writing with you.
To confirm your place, a 25% non-refundable deposit is required at registration.
The remaining payments are due as follows:
25% before Day 1 of the Programme
25% before Day 3 of the Programme
25% before Day 5 of the Programme
All fees are in New Zealand dollars (NZD) and exclude GST unless stated otherwise.
Your place is confirmed only once the deposit has been received. If any instalment is missed, we may suspend your participation or withdraw your place, and any payments made may be forfeited.
4. Cancellations, Refunds & Transfers
Your 25% deposit is non-refundable and confirms your place in the Programme.
If you withdraw or cancel your enrolment:
More than 30 days before Day 1 of your cohort - you’ll receive a full refund of any payments made above the non-refundable deposit.
Within 30 days of Day 1 or after the Programme has started - no refunds apply. Any unpaid instalments remain due in full unless we fill your place from the waitlist, in which case we may, at our discretion, reduce or waive the remaining balance.
All withdrawal or transfer requests must be made in writing to info@point16.co.nz.
Transfers to a later cohort:
You may request to transfer to a later cohort once only, subject to availability and our approval. Transfers are at our discretion and may incur an administration fee of $250.
If the new cohort’s investment fee is higher than your original cohort, you must pay the difference in price at the time of transfer to confirm your new place. If the new cohort’s fee is lower (for example, if you originally enrolled on a special rate), no refund or price adjustment will be provided.
Any payments you’ve already made will be credited toward the new cohort, minus any applicable fees.
Once a Programme has commenced (Day 1), transfers are not normally permitted.
If we cancel or materially change a Programme, you’ll be offered a full refund or the option to transfer to the next available cohort at no additional cost. We’ll notify you as soon as reasonably practicable.
5. Programme Changes
We may update the format, content, facilitators, venue, or delivery method (for example, moving to online delivery) if required. We’ll always aim to maintain or enhance the experience and will let you know of any significant changes. Material Programme changes are subject to a full refund or transfer in accordance with section 4.
6. Materials & Intellectual Property
All course content, frameworks, templates, guides, and resources remain the intellectual property of Point16 Limited.
You’re granted a personal, non-exclusive, non-transferable, revocable licence to use these materials for your own business growth and learning. You may not copy, share, publish, or distribute them without written consent.
7. Confidentiality & Participant Conduct
The Programme involves open discussion and peer learning. You agree to:
Keep confidential any sensitive or commercial information shared by others;
Avoid sharing cohort discussions, recordings, or materials outside the group; and
Participate respectfully and professionally at all times.
We reserve the right to remove a participant who breaches confidentiality or behaves in a way that disrupts or harms others. No refund will be provided in such cases.
We’ll treat all information you share with us as confidential except where disclosure is required by law or authorised by you.
8. Marketing & Media
We may capture photos, video, or testimonials during the Programme for marketing and promotional use (including social media, print, and website). By participating, you consent to this use. If you prefer not to be featured, please advise us in writing before the Programme begins.
9. Privacy & Data Protection
We collect your personal and business details to manage your enrolment, deliver the Programme, and communicate with you.
We comply with the New Zealand Privacy Act 2020. Your information may be shared with trusted facilitators and service providers for Programme delivery but will not be sold or disclosed to third parties without your consent, except as required by law.

10. Participant Responsibility
All sessions are delivered in person in Auckland. You are responsible for your own travel, accommodation, and insurance.
To get the most from the Programme, you must bring your laptop or device to each session. A short list of any additional materials or pre-work requirements will be provided before the Programme begins.
We’re not liable for loss, damage, or personal injury except to the extent required by New Zealand law.
11. Liability & Disclaimers
We provide education and strategic guidance to support business growth but do not guarantee specific outcomes.
To the maximum extent permitted by law:
We exclude all implied warranties or guarantees; and
Our total liability for any claim is limited to the total amount you’ve paid for your Programme enrolment.
We’re not liable for indirect or consequential losses such as lost profits, business interruption, or reputational damage.
12. Force Majeure
If an event beyond our reasonable control (for example, a natural disaster, pandemic, illness, or internet outage) prevents us from delivering the Programme as planned, we’ll make reasonable efforts to reschedule or provide equivalent delivery. Such events don’t entitle you to a refund.
13. Variation & Assignment
We may update these Terms by publishing a new version on our website and notifying current participants. Continued participation after notification means you accept the revised Terms.
You may not assign or transfer your enrolment or rights under these Terms without our written consent.
We may engage trusted third-party facilitators or partners to help deliver the Programme.
14. Severability & Entire Agreement
If any part of these Terms is found to be invalid or unenforceable, the rest still applies.
These Terms, together with your written or emailed confirmation of enrolment, make up the full agreement between you and Point16. They replace any prior discussions or promises, whether verbal or written.
15. Governing Law
These Terms are governed by New Zealand law.
